    • On July 15, 2024, California enacted the SAFETY Act, a law designed to safeguard student privacy and well-being. The Act prohibits and nullifies any school board policy, rule, or administrative regulation that mandates the forced outing of students, thereby ensuring that disclosures about a student’s gender identity or sexual orientation remain voluntary and student-directed. 

    • The SAFETY Act does not limit students’ and parents’ ability to discuss gender identities within their own families in the manner that they choose.

    • The SAFETY Act states that a school employee shall not be required to disclose any information related to a pupil’s LGBTQ+ identity to any other person without the pupil’s consent unless otherwise required by state or federal law.

The SAFETY Act does not restrict a parent’s right to request or access their child’s school records in accordance with existing laws.
